Florida does not require every existing home to have hardwired smoke alarms. That surprises most homeowners, because the rule that does exist is stricter: any new construction or permitted renovation has to get hardwired, interconnected, battery-backup smoke alarms, while an older home that isn’t being renovated can still legally run on standalone battery units. The gap between those two rules is where most Tampa Bay homes are quietly out of date, and it’s rarely the thing anyone thinks to check.
What Florida code actually requires, and when
The Florida Building Code, built on the National Electrical Code and NFPA 72, sets two different bars depending on what’s happening to the house. A newly built home or an addition has to have smoke alarms that are hardwired into the home’s electrical system, interconnected so that one alarm triggers all of them, and UL-listed, with a battery backup in case power drops. A permitted renovation, not just a cosmetic refresh but work that pulls a permit, triggers the same upgraded standard for the areas the permit covers.
An existing home that isn’t undergoing permitted work doesn’t have to meet that standard. Standalone smoke alarms using 10-year sealed batteries are still legal there, which is exactly why so much of Tampa Bay’s older housing stock, the pre-1975 bungalows in Seminole Heights and Tampa Heights, the rental stock through Sulphur Springs and the University area, still runs on the same non-interconnected battery units that have been on the ceiling since whoever owned the house last painted it.
The carbon monoxide rule is a separate law, and it’s easy to confuse
A lot of homeowners assume the smoke alarm rule and the carbon monoxide rule are the same thing. They’re not. Florida Statute 553.885 requires a carbon monoxide alarm within 10 feet of every room used for sleeping, but only in a building or addition constructed on or after July 1, 2008, and only if the home has a fossil-fuel-burning heater or appliance, a fireplace, or an attached garage. Unlike the smoke alarm rule, the CO statute explicitly allows either a hardwired or a battery-powered unit, and a combination smoke-and-CO alarm satisfies both requirements at once.
So a 2015-built home in Wesley Chapel or FishHawk with a gas water heater and an attached garage needs a CO alarm near every bedroom. A 1962 ranch in Town ‘n’ Country with no gas appliances and no garage owes nothing under that statute at all, no matter how old its wiring is. Treating the two rules as one is how homeowners end up either over-buying protection they don’t need or skipping protection they actually do.
The 10-year rule almost nobody checks
NFPA 72 sets a flat replacement standard: every smoke alarm, hardwired or battery, gets replaced at 10 years from its manufacture date, not the install date, regardless of whether it still passes a test. The date is stamped on the back or side of the unit. Sensor elements degrade with age, dust, and humidity long before the alarm stops beeping when you press the test button, which means a unit that “works fine” can still be too slow to respond to real smoke.
Tampa Bay’s humidity doesn’t help. Detectors in un-conditioned attics, garages, and older homes without continuous AC runtime see more moisture cycling than a detector in a newer, tightly sealed house, and that accelerates the same sensor drift NFPA is warning about. Between rental turnover in neighborhoods like Sulphur Springs and the University area and decades-old units in owner-occupied bungalows around Seminole Heights, expired smoke alarms are one of the most common things we find that nobody flagged as a problem.
When it’s worth hardwiring even if you’re not required to
Code doesn’t force an existing homeowner to upgrade, but a few situations make it worth doing anyway. If you’re already having a panel upgrade done, the electrician is in the attic and running new circuits regardless, so adding hardwired interconnected detectors at the same time costs a fraction of what it would as a standalone job. The same goes for homes getting aluminum wiring remediation or full modernization off an old Federal Pacific or Zinsco panel: once the walls and attic are already open for one project, detector wiring is a small add-on rather than its own trip.
Rental property is the other clear case. A hardwired, interconnected system means one failed unit doesn’t leave a tenant with silent protection, and it gives a landlord one less thing to chase between leases when a battery-only unit dies quietly in a unit nobody’s checked in months.
How this shows up on an inspection or before a sale
An expired or missing smoke alarm is exactly the kind of small, cheap-to-fix item that shows up on a buyer’s home inspection and becomes a negotiating point, the same pattern we see with GFCI gaps and old panels. It also intersects with the 4-point inspection insurers require on older Florida homes: the form doesn’t fail a house for a battery-powered detector by itself, but a functioning, correctly dated smoke alarm is a basic item that keeps an otherwise borderline electrical section from drawing extra scrutiny.
What replacement actually costs
A straightforward swap of an existing hardwired detector for a current interconnected unit typically runs $120 to $200 per unit installed. Converting a home from battery-only to a hardwired, interconnected system costs more because it means running new low-voltage wiring between units, usually $600 to $1,500 for a typical 3 to 5 detector single-family home, more if attic access is tight or the home has no existing wiring path to work with. Bundling the work into a panel upgrade or a rewire project already in progress is almost always the cheaper route.
